Understanding E-Verify and the I-9 Form

E-verify and Form I-9 are both tied to the Immigration Reform and Control Act of 1986 (IRCA.) which requires that business owners verify the legal status of every employee.

If an employer fails to get the appropriate documentation they face a fine between $110 and $1,100 per violation.  Penalties increase to a range of $375 to $16,000 if the employer knowingly continues to employ individuals without proper verification.

The employee must show proof that they are U.S. citizens or nationals; lawful, permanent residents; or otherwise permitted to work in the United States.   The documentation must be provided within three days of hire.

E-Verify is the Internet-based system that compares the information from Form I-9 (entered into the system by the employer) to records at the U.S. Department of Homeland Security and the Social Security Administration.
